Hermeneutik gilt heutzutage meistens als Bestandteil der Philosophie. Das ist aber eine verkürzte Sicht ihrer Gegenwart und erst recht ihrer Geschichte. Denn von Haus aus bezeichnet Hermeneutik alle Verfahren zur Auslegung von Texten. Sie begann in der Antike mit der Neu-Interpretation klassischer Dichter. Anschließend lernten die Christen die jüdische Bibel im Sinne ihres Evangeliums auszulegen. Sodann brauchte auch schriftliches Recht Interpretation, ebenso die philologisch-historische Quellenkritik der Geschichtswissenschaft. Jetzt erst führte die Philosophie die verschiedenen Varianten zu einer allgemeinen Hermeneutik zusammen. Daneben (...) hatten aber vier andere Wissenschaften eigene Auslegungstheorien und Methodenlehren entwickelt. Diese fünf Entwicklungspfade des gesamten Feldes werden hier zum ersten Mal von den Anfängen bis zur Gegenwart im Überblick dargestellt. (shrink)

Mr. Zeidler is a distinguished Kant- and Neo-Kantian-scholar who has reconstructed Kant's concept of transcendental logic in connection with the logic of the concept of Hegel and the logic of symbolization of Peirce. What is impressive in the growth of modal logic has not been so much the quick accumulation of results but the richness of its thematic dev- opments. In the 1960s, when Kripke semantics gave new credibility to the logic of modalities? which was already known and appreciated in the Ancient and Medieval times? no one could (...) have foreseen that in a short time modal logic would become a lively source of ideas and methods for analytical philosophers,historians of philosophy,linguists, epistemologists and computer scientists. The aim which oriented the composition of this book was not to write a new manual of modal logic buttoo?ertoeveryreader,evenwithnospeci?cbackground in logic, a conceptually linear path in the labyrinth of the current panorama of modal logic. The notion which in our opinion looked suitable to work as a compass in this enterprise was the notion of multimodality, or, more speci?cally, the basic idea of grounding systems on languages admitting more than one primitive modal operator. The Dialectical Forge identifies dialectical disputation as a primary formative dynamic in the evolution of pre-modern Islamic legal systems, promoting dialectic from relative obscurity to a more appropriate position at the forefront of Islamic legal studies. The author introduces and develops a dialectics-based analytical method for the study of pre-modern Islamic legal argumentation, examines parallels and divergences between Aristotelian dialectic and early juridical jadal-theory, and proposes a multi-component paradigm—the Dialectical Forge Model—to account for the power of jadal in shaping Islamic (...) law and legal theory.In addition to overviews of current evolutionary narratives for Islamic legal theory and dialectic, and expositions on key texts, this work shines an analytical light upon the considerably sophisticated “proto-system” of juridical dialectical teaching and practice evident in Islam’s second century, several generations before the first “full-system” treatises of legal and dialectical theory were composed. This proto-system is revealed from analyses of dialectical sequences in the 2nd/8th century Kitāb Ikhtilāf al-ʿIrāqiyyīn / ʿIrāqiyyayn through a lens molded from 5th/11th century jadal-theory treatises. This paper embeds the core part of Discourse Representation Theory in the classical theory of types plus a few simple axioms that allow the theory to express key facts about variables and assignments on the object level of the logic. It is shown how the embedding can be used to combine core analyses of natural language phenomena in Discourse Representation Theory with analyses that can be obtained in Montague Semantics.

This paper provides an axiomatic analysis of sufficientarian social evaluation. Sufficientarianism has emerged as an increasingly important notion of distributive justice. We propose a class of principles that we label generalized critical-level sufficientarian orderings. The distinguishing feature of our new class is that its members exhibit constant critical levels of well-being that are allowed to differ from the threshold of sufficiency. Our basic axiom assigns priority to those below the threshold, a property that is shared by numerous other sufficientarian approaches. (...) When combined with the well-known strong Pareto principle and the assumption that there be a constant critical level, the axiom implies that the critical level cannot be below the threshold. The main results of the paper are characterizations of our new class and an important subclass. As a final observation, we identify the generalized critical-level sufficientarian orderings that permit us to avoid the repugnant conclusion and the sadistic conclusion, which are known as two fundamental challenges in population ethics. Based on a comparison of various sources, such as different editions, correspondence, reviews, and lecture transcripts, it is shown that Ludwig Heinrich Jakob’s Outline of the General Logic and Critical Elements of Metaphysics in General uses one or more transcripts of Kant’s Logic Lectures as a source. In addition to the thus far known texts by Kiesewetter and Hippel, Jakob’s textbook should therefore also be added to the list of secondary transmissions of Kant’s Logic Lectures.

Using a philosophical framework that is informed by neuroscience as well as contemporary legal cases such as Terri Schiavo, this text offers readers an introduction to this topic. It looks at the ethical implications of our knowledge of the brain and medical treatments for neurological diseases.

Im Mittelpunkt dieses Bandes stehen aktuelle Themen politischer Ethik, die sich den drei Bereichen Migration, Europa und Populismus zuordnen lassen. Die ethischen Herausforderungen, die die internationale Migration mit sich bringt, erfordern das Zusammenspiel nationaler und europäischer Ebenen. Entsprechend ist der große Rahmen der hier versammelten Beiträge eine transnational zu denkende Sozialethik in den Strukturen Europas. Zu den Reaktionen auf die Migration gehört unter anderem der erstarkende Rechtspopulismus, der sich in der Regel dezidiert europaskeptisch positioniert. Insofern ergeben sich aus dem Nachdenken (...) über Europa, Migration und Populismus Spannungsfelder und Argumentationsmuster, die mit grundlegenderen Fragen politischer Ethik verbunden sind. We examine a general class of variable-value population principles. Our particular focus is on the extent to which such principles can avoid the repugnant and sadistic conclusions. We show that if a mild limit property is imposed, avoidance of the repugnant conclusion implies the sadistic conclusion. This result generalizes earlier observations by showing that they apply to a substantially larger class of principles. Our second theorem states that, under the limit property, the axiom of mere addition also conflicts with avoidance (...) of the repugnant conclusion. This result is a consequence of a similar observation that appears in the earlier literature. (shrink)
